These Terms & Conditions apply to purchases made through the Hamper Collective website and to your use of the website. Please read them before placing an order.
1. About these terms
These terms apply when you buy from Hamper Collective.
Legal information: Hamper Collective is operated by United Flow Ltd, registered in England and Wales under company number 08408252. Registered office: 4 Horton Road, Yiewsley, West Drayton, England, UB7 8JL. VAT registration number: GB 221001394. Email: hello@hampercollective.co.uk.
2. These terms and consumer rights
Nothing in these terms limits or excludes rights you have under applicable consumer law, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 where they apply.
Corporate or other business-to-business orders may also be subject to separate quotations, purchase-order terms or written agreements. Where separate terms are agreed, those terms take priority to the extent of any conflict.
3. Products and descriptions
We take reasonable care to describe and photograph our products accurately. Food and drink packaging, labels, vintages, colours and presentation can change. Images are illustrative and colours may also vary by screen.
Where an item becomes unavailable, we may make a reasonable substitution with a product of similar character and equal or greater value. If a proposed change would materially alter the nature of the gift, we will try to contact you before dispatch. Any substitution will be made with reasonable care and will not knowingly conflict with a dietary requirement specifically agreed with us.
4. Allergens and dietary information
Hampers can contain products from multiple manufacturers and recipes can change. Customers must check the current ingredient and allergen information for individual items, including the manufacturer's label on receipt. If an allergy is severe, please contact us before ordering so that we can check the current products. We do not guarantee that a hamper is free from a particular allergen unless we expressly state this.
Nothing on the website is medical or dietary advice.
5. Placing an order
By placing an order you are offering to buy the products in your basket. You must provide accurate contact, billing and delivery information and check the order carefully before paying.
An automated order acknowledgement confirms that we have received your order; it does not necessarily mean we have accepted it. We may decline or cancel an order where, for example, a product is unavailable, payment cannot be authorised, delivery is not possible, there is an obvious pricing error, or we reasonably suspect fraud or unlawful activity. If we cancel after taking payment, we will refund the amount due.
6. Prices and payment
Consumer prices are shown in pounds sterling and include VAT where applicable unless clearly stated otherwise. Delivery charges and any optional extras are shown before you complete checkout.
Payment is handled by the payment methods made available at checkout. You confirm that you are authorised to use the payment method provided.
Obvious pricing or description errors do not bind us. If we identify a material error before dispatch, we will contact you and give you the option to continue at the correct price or cancel for a refund.
7. Gift orders and recipient information
If you send a gift directly to another person, you are responsible for providing an accurate delivery address and appropriate recipient details. You must have a lawful reason to provide us with another person's personal information for delivery. We will use recipient information primarily to fulfil and support the delivery.
You are responsible for the content and accuracy of any gift message or personalisation submitted with an order.
8. Delivery
Available delivery services, charges and estimated timings are shown at checkout or on the relevant product page. Unless expressly stated as guaranteed, delivery dates and times are estimates.
We remain responsible for the goods until they are delivered to you, the recipient, or another person you have nominated to receive them, subject to applicable law.
You are responsible for providing a complete and deliverable address. Where delivery cannot be completed because information supplied by you is incorrect or nobody is available where attendance is reasonably required, reasonable redelivery or return costs may apply.
Events outside our reasonable control, including severe weather, transport disruption or carrier network failures, can affect delivery. We will act reasonably to minimise disruption and your statutory rights remain unaffected.
9. Chilled and perishable goods
Chilled goods are sent using packaging and services selected for the nature of the products. The recipient should refrigerate chilled items promptly on receipt and follow all use-by dates and storage instructions.
Please choose a delivery address where a chilled or perishable parcel can be received promptly. Delayed receipt caused by an incorrect address, refusal, failed age verification or repeated missed delivery may affect product quality.
10. Alcohol
You must be at least 18 years old to purchase alcohol from us. By ordering an alcohol-containing product, you confirm that you are 18 or over.
Alcohol will only be delivered in accordance with applicable licensing and age-verification requirements. The recipient may be asked for acceptable proof of age at delivery. If age cannot be verified where required, the alcohol will not be handed over and reasonable redelivery or return costs may apply where permitted.
11. Changes and cancellation before dispatch
If you need to change or cancel an order, contact us promptly. We will try to help, but once packing, personalisation or dispatch has begun, a change may not be possible.
12. Consumer cancellation rights
For eligible distance purchases, consumers generally have 14 days after receiving the goods to tell us they wish to cancel, and a further 14 days to return the eligible goods.
Legal exceptions apply. Change-of-mind cancellation rights may not apply, for example, to goods made to your specification or clearly personalised; goods liable to deteriorate or expire rapidly; and certain sealed goods that are not suitable for return for health protection or hygiene reasons once unsealed.
Because our hampers may contain a mixture of product types, the legal position can depend on the particular goods in your order. Contact us and we will apply your rights as required by law.
For eligible change-of-mind returns, you are normally responsible for the direct cost of returning the goods unless we agree otherwise. We may reduce a refund where the value of returned goods has been reduced by handling beyond what is reasonably necessary to establish their nature and characteristics.
See our Returns & Refunds Policy for the process and cancellation form.
13. Faulty, damaged or incorrect goods
Your statutory rights apply if goods are faulty, damaged, unsafe or not as described. Please contact us promptly with your order number and evidence that reasonably helps us investigate, such as photographs. Depending on the circumstances and the law, the remedy may include replacement, refund or another appropriate solution.
14. Refunds
Where a refund is due, it will normally be returned to the original payment method. For a valid consumer cancellation, we will refund the standard outbound delivery charge where required by law, but not any extra amount paid for an enhanced delivery service beyond the standard service.
15. Corporate and bespoke orders
Large-volume, branded, multi-address and bespoke corporate orders may have different lead times, payment arrangements, cancellation rules and fulfilment terms. We will set these out in the relevant quotation or written agreement. Consumer cancellation rights do not apply to genuine business purchases in the same way as consumer orders.
16. Website use and intellectual property
The website and its text, branding, graphics, photographs and other content are owned by or licensed to us unless stated otherwise. You may use the website for lawful personal or business purchasing purposes, but you may not reproduce or exploit our content commercially without permission.
17. Liability
We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.
Where you are a consumer, we are responsible for losses that are a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. We are not responsible for business losses suffered by a consumer.
Where you purchase wholly for business purposes, liability may be subject to any separate business terms agreed with you.
18. Privacy and cookies
Our handling of personal data is explained in our Privacy Policy and Your Data & GDPR Rights page. Our use of cookies and similar technologies is explained in our Cookie Policy.
19. Governing law
These terms are governed by the laws of England and Wales. If you are a consumer living elsewhere in the UK, you retain any mandatory rights and may be able to bring proceedings in the courts applicable to where you live.
20. Changes to these terms
We may update these terms from time to time. The version applying to an order is the version in force when the order is placed, unless a change is required by law and applies differently.
21. Contact
Questions about these terms can be sent through our Contact page or to hello@hampercollective.co.uk.
